Electronic Bid Submission

Electronic bid submission is the mandatory digital process for submitting offers in public procurement through certified e-procurement platforms.

What is Electronic Bid Submission?

Electronic bid submission (digitale Angebotsabgabe) is the process of submitting procurement offers through authorized electronic platforms rather than in paper form. Since October 2018, electronic submission has been mandatory for all above-threshold procurement procedures in Germany, and it is increasingly required for below-threshold procurement as well. This digital transformation has fundamentally changed how companies participate in public tenders.

The submission process typically involves downloading the tender documents from a procurement portal, preparing the bid using either the portal's built-in tools or compatible offline software, and uploading the completed bid package before the submission deadline. Bids are encrypted during transmission and stored securely until the designated opening time, ensuring that no one, including the contracting authority, can access the contents before the bid opening.

Electronic bid submission requires compliance with specific technical standards and formats. Depending on the platform, bidders may need to use particular file formats, comply with size limitations, and in some cases provide an electronic signature or sign through the platform's authentication mechanism. The choice of acceptable signature levels (simple, advanced, or qualified electronic signature) is determined by the contracting authority in the tender documents.

Why It Matters for Bidders

Mastering electronic bid submission is no longer optional but a fundamental prerequisite for participating in public procurement. Bidders must ensure they have the necessary technical infrastructure, including compatible hardware, software, up-to-date browser versions, and valid certificates for electronic signatures where required.

Technical issues during submission are among the most common reasons for failed bid submissions. Bidders should conduct test submissions on unfamiliar platforms, verify file sizes and formats well in advance, and plan for sufficient time to resolve any technical difficulties. Most platforms provide a submission confirmation that bidders should save as proof of timely delivery. It is strongly recommended to submit bids well before the deadline to account for potential platform congestion or technical disruptions.

Legal Framework

The requirement for electronic bid submission is established in Section 53 VgV for above-threshold procurement. The UVgO contains provisions for electronic submission in below-threshold procurement. EU Directive 2014/24/EU Article 22 mandates electronic communication in procurement procedures. Technical standards for electronic submission are further specified in the eIDAS Regulation (EU) No 910/2014 regarding electronic signatures and identification.
