NUTS Codes

NUTS codes are the EU's standardized geographic classification system used to identify the location where a public contract will be performed.

What are NUTS Codes?

NUTS codes (Nomenclature of Territorial Units for Statistics) are a hierarchical geographic classification system developed by Eurostat, the statistical office of the European Union, to provide a uniform breakdown of territorial units across all EU member states. In public procurement, NUTS codes are used in contract notices to identify the geographic location where a contract will be performed, enabling bidders to filter procurement opportunities by region.

The NUTS system is structured in three levels of increasing geographic specificity. NUTS 1 represents major socio-economic regions (in Germany, these correspond to groups of federal states or large individual states). NUTS 2 represents basic regions for the application of regional policies (largely corresponding to German federal states or government districts). NUTS 3 represents small regions for specific diagnoses (in Germany, these correspond to districts and independent cities). In addition, LAU (Local Administrative Units) codes provide even more granular geographic identification.

In procurement notices, NUTS codes fulfill a dual purpose. They enable efficient geographic filtering of procurement opportunities, allowing companies to identify tenders in their region of operation or in areas where they are willing to perform. They also support statistical analysis of procurement patterns, enabling policymakers to assess the regional distribution of public spending and the extent to which companies from different regions participate in procurement procedures.

Why It Matters for Bidders

NUTS codes are an essential search parameter for companies monitoring procurement opportunities. By configuring their tender monitoring systems with relevant NUTS codes, bidders can efficiently filter the thousands of contract notices published daily on TED and national portals to identify geographically relevant opportunities. Companies should include NUTS codes for all regions where they have operational capacity or are willing to establish a local presence.

Understanding NUTS codes also helps bidders assess logistical requirements and cost implications. A contract to be performed in a remote region may involve significant travel, accommodation, or local subcontracting costs that must be factored into the pricing. The NUTS code in the contract notice provides an early indication of these geographic considerations.

Legal Framework

The NUTS classification is established by EU Regulation (EC) No 1059/2003 and its subsequent amendments. The use of NUTS codes in procurement notices is mandated by EU Directive 2014/24/EU and specified in the eForms standard. In Germany, the VgV requires the inclusion of NUTS codes in above-threshold contract notices. The current NUTS 2024 classification, effective for Germany, divides the country into 16 NUTS 1 regions, 38 NUTS 2 regions, and 401 NUTS 3 regions.
