Contract Award Notice

A contract award notice is the official announcement published after a public contract has been awarded, informing the market about the outcome of the procurement procedure.

What is a Contract Award Notice?

A contract award notice (Ex-post-Bekanntmachung) is the formal publication issued after a contracting authority has completed a procurement procedure and awarded a contract. This notice informs the market about the outcome of the procedure, including the identity of the successful bidder, the contract value, and key details about the awarded contract. Publication of a contract award notice is mandatory for above-threshold procurement under EU law.

The notice must be dispatched to TED for publication no later than 30 days after the contract has been awarded. It contains standardized information including the contracting authority's details, the subject matter and CPV codes, the procedure type used, the number of bids received, the name and address of the successful bidder, the total contract value, and whether the contract is likely to be subcontracted. For framework agreements, the notice must be published either for each individual call-off or in aggregate on a quarterly basis.

Contract award notices serve multiple purposes. They provide transparency about how public funds are being spent, enable statistical analysis of procurement markets, allow unsuccessful bidders to understand the competitive landscape, and create a public record that supports accountability and audit functions. The data from contract award notices is also used by the European Commission to monitor the functioning of the EU internal market for public procurement.

Why It Matters for Bidders

For bidders, contract award notices provide valuable market intelligence. By reviewing award notices in their sector, companies can identify which competitors are winning contracts, at what prices, and through which procedures. This information supports strategic business development, helping companies calibrate their pricing, identify partnership opportunities, and understand market trends.

Unsuccessful bidders can use the information in contract award notices to assess whether the award was made in accordance with the stated criteria and whether there may be grounds for a legal challenge. The notice also provides benchmarking data that can help companies improve their future bid strategies.

Legal Framework

The obligation to publish contract award notices is established in Section 39 VgV for above-threshold procurement. EU Directive 2014/24/EU Article 50 mandates the publication and specifies the required content. Since October 2023, contract award notices must be published in the eForms format. For below-threshold procurement, publication obligations vary by jurisdiction but are increasingly being adopted voluntarily to promote transparency.
