What is the Application Deadline?
The application deadline (Bewerbungsfrist) is the final date by which candidates must submit their applications to participate in multi-stage procurement procedures such as the restricted procedure, negotiated procedure, competitive dialogue, or innovation partnership. In these procedures, the procurement is divided into at least two phases: a participation competition (Teilnahmewettbewerb) where candidates demonstrate their suitability, followed by a bid submission phase for qualified candidates only.
The application deadline applies specifically to the first phase. Candidates must submit their applications, including all required suitability evidence such as references, financial statements, technical certifications, and declarations, by the stated deadline. As with the bid submission deadline, the application deadline is strictly enforced, and late applications are excluded from the procedure.
For above-threshold procurement, the minimum application deadline is 30 days from the date of dispatch of the contract notice. This period can be reduced to 15 days in cases of duly justified urgency, provided that the contracting authority can demonstrate that the shorter deadline still allows candidates sufficient time to prepare their applications. For below-threshold procurement, shorter deadlines are generally permissible, though they must remain reasonable given the complexity of the requirements.
Why It Matters for Bidders
The application deadline is the first critical milestone in multi-stage procedures. Unlike single-stage open procedures where bidders submit a complete offer, multi-stage procedures require bidders to invest resources in the application phase before even knowing whether they will be invited to bid. This front-loaded effort makes early identification of relevant tenders and prompt commencement of application preparation essential.
Bidders should maintain pre-prepared suitability documentation that can be quickly adapted for individual applications. Having an up-to-date reference list, current financial statements, and valid certifications readily available significantly reduces the time needed to compile a complete application. Minimum application deadlines are set out in Sections 15 to 17 VgV for above-threshold procurement. The UVgO governs deadlines for below-threshold procedures. VOB/A contains specific provisions for construction procurement. EU Directive 2014/24/EU Articles 28 to 31 establish the European minimum periods for receipt of requests to participate.
