What is a Participation Competition?
The participation competition (Teilnahmewettbewerb) is the initial qualification phase in multi-stage procurement procedures such as the restricted procedure, negotiated procedure with prior publication, competitive dialogue, and innovation partnership. During this phase, interested companies submit applications (Teilnahmeantraege) demonstrating their suitability to perform the contract. The contracting authority evaluates these applications against predefined selection criteria and invites the most suitable candidates to participate in the subsequent bid submission or negotiation phase.
The participation competition serves a dual purpose: it ensures that only qualified companies advance to the bidding phase, and it reduces the number of bids that the contracting authority must evaluate, making the process more manageable for complex procurements. The contracting authority must specify the minimum number of candidates it intends to invite (typically at least five for restricted procedures and at least three for negotiated procedures) and, where appropriate, a maximum number.
The selection criteria used in the participation competition relate exclusively to the suitability of the candidates, not to the merits of their potential offers. Typical criteria include the company's experience with comparable projects (demonstrated through references), financial stability (proven through financial statements and insurance certificates), technical equipment and personnel qualifications, and quality management or environmental management system certifications. The criteria and their weighting must be stated in the contract notice.

The selection criteria are regulated by Sections 44 to 46 VgV. EU Directive 2014/24/EU Articles 28 to 31 establish the European framework. The minimum number of invited candidates is specified in Section 51 VgV.
