What is a Variant Bid?
A variant bid (Nebenangebot) is an alternative offer submitted by a bidder that deviates from the specifications or requirements stated in the tender documents. While the main bid (Hauptangebot) must comply exactly with the contracting authority's specified requirements, a variant bid proposes a different technical solution, alternative materials, a modified delivery concept, or other deviations that the bidder believes could better serve the contracting authority's needs or offer improved value for money.
Variant bids are only permissible if the contracting authority explicitly allows them in the contract notice. For above-threshold procurement, the contracting authority must also define minimum requirements that variant bids must satisfy, ensuring a baseline for comparability. The contracting authority may also specify the areas in which variants are welcome, such as technical solutions, delivery schedules, or payment terms.
A variant bid can only be submitted alongside a compliant main bid. This requirement ensures that the contracting authority always has a comparable baseline offer and is not left with only non-standard proposals that may be difficult to evaluate against each other. The evaluation of variant bids uses the same award criteria as for main bids, but the assessment must account for the specific characteristics and advantages of the proposed alternative approach.
Why It Matters for Bidders
Variant bids offer a strategic opportunity for innovative and technically strong bidders to differentiate themselves from competitors. By proposing an alternative approach, bidders can showcase their expertise, creativity, and understanding of the contracting authority's underlying needs. A well-crafted variant bid that offers measurably better outcomes such as lower lifecycle costs, higher performance, or faster delivery can provide a decisive competitive advantage.
However, preparing a variant bid requires additional effort beyond the mandatory main bid. Bidders must ensure that their variant meets the specified minimum requirements and that the advantages are clearly quantified and documented. A variant bid that fails to meet the minimum requirements or that does not clearly demonstrate its added value is unlikely to be successful and represents wasted effort.
Legal Framework
Variant bids are regulated in Section 35 VgV for above-threshold procurement, which requires that the permissibility of variants be stated in the contract notice and that minimum requirements be defined. The UVgO contains analogous provisions for below-threshold procurement. For construction works, VOB/A addresses variant bids (Nebenangebote). EU Directive 2014/24/EU Article 45 establishes the European framework for the treatment of variants.
