Bid Opening

Bid opening is the formal procedure in which submitted bids are opened, their key details are recorded, and the contents are made available for evaluation.

What is Bid Opening?

Bid opening (Submission) is the formal, structured procedure through which bids received by the contracting authority are officially opened after the expiry of the bid submission deadline. This process ensures the integrity and confidentiality of the procurement by confirming that no bids were opened or accessed before the designated time and that all bids received by the deadline are treated equally.

In traditional paper-based procurement, the submission was a physical event where bids were opened in the presence of witnesses, and in construction procurement, bidders themselves were entitled to attend. The submission officer (Verhandlungsleiter) would open each bid, read aloud the bidder's name and the total bid price, and record these details in the submission protocol. This public opening provided transparency and a verifiable record that all bids were treated consistently.

With the transition to electronic procurement, the submission process has changed fundamentally. Electronic bids are encrypted during submission and stored in a secure system that prevents premature access. At the designated opening time, the system decrypts the bids, and the contracting authority records the relevant details in an electronic protocol. In most electronic procurement procedures above the EU thresholds, bidders no longer have the right to attend the opening. However, in construction procurement under the VOB/A, the right of bidders to be present at the opening is still maintained, even when bids are submitted electronically.

Why It Matters for Bidders

The bid opening process provides an important safeguard for fair competition. Bidders can be confident that their bids are kept confidential until the designated opening time and that all bids are treated equally. In construction procurement where bidders may attend the opening, they gain immediate insight into the competitive landscape, learning the number of bids received and the price levels of their competitors.

Bidders should request a copy of the submission protocol, which documents the key details of all bids received. This information can be valuable for evaluating one's competitive position, benchmarking pricing, and identifying potential irregularities that might warrant further inquiry or challenge.

Legal Framework

The bid opening process is regulated in Section 55 VgV for above-threshold procurement of services and supplies. For construction procurement, VOB/A Section 14 contains detailed provisions on the submission procedure, including the right of bidders to attend. The UVgO addresses the opening of bids in below-threshold procurement. Electronic bid opening is governed by the e-procurement requirements of the VgV and the applicable platform-specific regulations.
