What is the Bid Submission Deadline?
The bid submission deadline (Angebotsfrist) is the strict cutoff date and time by which all bids must be received by the contracting authority. In German and EU procurement law, this deadline is absolute: bids received after the stated deadline are excluded from the procedure without exception, regardless of the reason for the delay. This rule ensures equal treatment of all bidders and the integrity of the procurement process.
The minimum length of the bid submission deadline depends on the type of procurement procedure and whether the procurement is above or below the EU thresholds. For open procedures above the EU thresholds, the standard minimum deadline is 35 days from the date of dispatch of the contract notice. This can be reduced to 15 days if a prior information notice was published, or to 15 days if electronic submission is accepted and documents are available electronically. For restricted and negotiated procedures, specific minimum deadlines apply to each phase.
Contracting authorities must set deadlines that allow bidders sufficient time to prepare and submit their offers in light of the complexity and scope of the contract. If significant changes are made to the tender documents or additional information is provided during the procedure, the contracting authority may be required to extend the bid submission deadline accordingly.
Why It Matters for Bidders
The bid submission deadline is arguably the single most critical date in any procurement procedure. Missing it by even one second means automatic exclusion with no possibility of appeal on this point. Bidders must build internal timelines that account for the complexity of bid preparation, internal review and approval processes, and potential technical issues with electronic submission platforms.
Best practice is to submit bids well before the deadline to mitigate risks such as platform outages, upload errors, or last-minute technical difficulties. Many experienced bidders aim to complete their submissions at least 24 hours before the deadline. Bidders should also verify the exact time zone and clock reference used by the procurement platform.
Legal Framework
Minimum bid submission deadlines are specified in Sections 15 to 17 VgV for above-threshold procurement. The UVgO contains provisions for below-threshold deadlines. For construction works, the VOB/A sets out applicable time limits. EU Directive 2014/24/EU Articles 27 to 31 establish the minimum deadlines at the European level.
